Terms and conditions

1. Who we are and when these terms apply

These terms apply to every service Letzscale S.à r.l.-S ("Letzscale", "we"), 19 Um Kalleksuewen, L-7480 Tuntange (Helperknapp), Luxembourg, RCS Luxembourg B309937, provides to a client ("you"): the free AI Visibility Snapshot, the Starter audit, the AI Visibility Program, Monitoring and any custom scope.

Our services are for businesses and other organisations only, not for consumers. By accepting a quote or paying for a service, you confirm that you act for an organisation. Where a signed quote says something different from these terms, the quote applies.

2. The free AI Visibility Snapshot

The Snapshot is free and creates no obligation to buy anything. It is limited to one per company. We select a limited number of businesses each week and may decline a request, for example when it does not come from a business or repeats an earlier request.

3. Quotes and contracts

The scope and price of every paid service are agreed in writing before work starts, in a quote or order confirmation. The contract is formed when you accept it in writing or pay for it.

4. Prices and payment

• All prices are in euros and exclude VAT, which is added at the applicable rate.
• Payment is made online through our payment provider, Stripe. By paying, you authorise us to charge the payment method you provide for the amounts described in these terms, including recurring payments.
• The Starter audit and the AI Visibility Program are paid in full when you order. The AI Visibility Program can instead be paid in 3 monthly instalments, charged automatically to the same payment method. The instalments are a way to pay for the agreed scope, not a subscription: all of them remain due once work has started.
• If you move from a Starter audit to the AI Visibility Program within 30 days of receiving the Starter audit, the full Starter fee is deducted from the price.
• If a payment fails, we will tell you and try again. If it is still unpaid 14 days after our reminder, we may pause the service until it is paid.

5. Monitoring subscription, renewal and cancellation

• Monitoring is a subscription. It is billed in advance, monthly or yearly, and renews automatically at the end of each billing period until it is cancelled. Each renewal is charged automatically to your payment method.
• The minimum term is 3 months from the start of the subscription.
• After the minimum term, you can cancel at any time with 30 days' notice. The subscription ends at the end of the billing period in which the notice period expires, and Monitoring continues, and is billed, until then.
• A yearly subscription renews for another year unless you cancel at least 30 days before its renewal date.
• To cancel, email hello@letzscale.com. We confirm every cancellation in writing, with the date the subscription ends.
• Payments already made are not refunded for the remaining part of a billing period, unless the law requires it.
• We may change the price of a subscription by telling you at least 30 days before the change applies. If you do not accept the new price, you can cancel before it takes effect without notice costs.

6. Delivery and your cooperation

Delivery times are given in business days and run from the moment we have everything we need from you, such as access to your website or content management system and answers to our questions. Delays in providing these move the delivery date by the same amount.

7. What we can and cannot promise

AI assistants such as ChatGPT, Google AI Overviews, Gemini, Microsoft Copilot, Claude and Perplexity are run by third parties and change over time. We do the agreed work carefully and measure its effect with the same questions, but we cannot guarantee that any assistant will name or describe your business in a particular way, or keep doing so.

8. Intellectual property

Once you have paid in full, you may use the reports we deliver for your organisation's own purposes, and the content we write for your website belongs to you. We keep the rights to our methods, question sets, tools and templates.

9. Confidentiality

We keep confidential any non-public information you share with us and use it only to deliver our services. You keep our quotes and non-public working methods confidential.

10. Liability

Our total liability for a service is limited to the amount you paid for that service in the 12 months before the claim. We are not liable for indirect loss, such as lost profit, lost business or loss of reputation. These limits do not apply to gross negligence, wilful misconduct, or anything else the law does not allow us to limit.

11. Personal data

We handle personal data as described in our privacy policy.

12. Changes to these terms

We may update these terms. The version in force when you accept a quote applies to that service. For subscriptions, we tell you about material changes at least 30 days before they apply, and you may cancel before then.

13. Applicable law and courts

These terms are governed by Luxembourg law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the courts of Luxembourg City.
